Terms of Service

Effective date: September 16, 2025
Applies to: harmony.education and harmonyed.com (the “Sites”), the parent/guardian dashboard, and related portals described below.

Who we are. “Harmony Education Services” (“Harmony,” “we,” “us,” or “our”)

By creating an account, accessing our Sites, or clicking “I agree,” you accept these Terms. If you do not agree, do not use the Sites.


1) Who may use the Sites (Eligibility & Parent/Guardian Authority)

  • Parent/guardian‑only. Our Sites are designed for parents/guardians and schools. Children under 13 may not create accounts or use the Sites.
  • Representation. You represent that you are the child’s parent or legal guardian (or an authorized school representative) and have authority to provide and manage the child’s information for educational purposes.
  • Future student portal (13+). If Harmony later offers a student portal, students must be age 13 or older, and additional terms/consents will apply prior to use.

2) Accounts, Security & E‑Sign

  • Account security. You must keep your credentials confidential, use strong passwords and MFA where available, and promptly notify us at compliance@harmonyed.com of any suspected compromise. You are responsible for activity under your account.
  • Electronic communications & signatures. You consent to receive electronic communications, disclosures, and notices from Harmony and to sign electronically any acknowledgments or agreements presented via the Sites. Electronic records and signatures have the same legal effect as ink.
  • Email preferences. We send account/operational messages by email. You may unsubscribe from marketing emails at any time; operational emails will continue while your account is active.

3) Parent Direction to Provision Vendor Accounts

At your direction, Harmony may share minimum necessary parent and student information (e.g., names, email, grade) with approved curriculum or service vendors to provision accounts or enable services for your student. Those vendors’ own terms and privacy policies apply to their services.


4) Your Content; Photos; Limited License to Harmony

  • Uploads. You may upload content (e.g., photos, documents, forms). You retain your rights in your content.
  • License to Harmony (internal services only). You grant Harmony a limited, revocable, non‑exclusive, royalty‑free license to host, use, reproduce, and share your content internally (and with your school/district and service providers) only as needed to provide the services (e.g., identity verification, program support, school sharing). We will not publish student photos or other content publicly for marketing without your separate consent.
  • Takedown. You may request removal of content you uploaded; we may retain copies as required by law or school contracts.

5) Acceptable Use

You agree not to: (a) provide any person’s sensitive information without authorization; (b) infringe others’ rights or upload unlawful content; (c) attempt to access accounts or data you are not authorized to access; (d) interfere with the Sites or bypass security; (e) use the Sites for advertising unrelated products or services; or (f) copy, scrape, or reverse‑engineer the Sites except as permitted by law.


6) Third‑Party Services & Links

The Sites may link to third‑party websites or services (e.g., curriculum vendors). Harmony does not control and is not responsible for those services. Your use of third‑party services is governed by their terms and policies.


7) Copyright; DMCA

If you believe content on the Sites infringes your copyright, send a DMCA notice to our DMCA Agent at compliance@harmonyed.com or by mail to the address above with: (1) your signature; (2) identification of the work and alleged infringing material; (3) your contact info; (4) a statement of good‑faith belief; and (5) a statement that the information is accurate and, under penalty of perjury, you are authorized to act. We may remove content and notify the uploader. Counter‑notices may be submitted per 17 U.S.C. §512.


8) Changes to the Sites or Terms

We may update the Sites and these Terms. If changes are material, we will post the updated Terms with a new effective date and may provide additional notice. Your continued use after changes means you accept the new Terms.


9) Disclaimers

The Sites and services are provided “as is” and “as available.” To the maximum extent permitted by law, Harmony disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. Harmony does not guarantee uninterrupted or error‑free operation.


10) Limitation of Liability; Indemnity

  • No special damages. To the maximum extent permitted by law, Harmony will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from or related to the Sites or these Terms.
  • Indemnity. You agree to defend, indemnify, and hold Harmony harmless from claims arising out of (a) your content; (b) your use of the Sites in violation of these Terms or law; or (c) unauthorized sharing of others’ personal information.

11) Termination

We may suspend or terminate access at any time for violation of these Terms, risk to users or systems, legal or school requirements, or inactivity. You may stop using the Sites at any time. Certain provisions survive termination (e.g., licenses as limited above, disclaimers, limitations of liability, indemnity, governing law, and dispute provisions).


12) Governing Law; Venue; Fees

These Terms are governed by the laws of the State of Utah, without regard to conflict‑of‑law rules. You and Harmony consent to the exclusive jurisdiction and venue of state and federal courts located in Utah for any action not subject to mandatory arbitration (none required under these Terms). Prevailing‑party fees: The prevailing party in any action to enforce these Terms is entitled to reasonable attorneys’ fees and costs.


13) Notices; Contact

Notices to Harmony must be sent to compliance@harmonyed.com and by mail to the address above. We may provide notices to you via email, in‑product messages, or by posting on the Sites. For support, contact compliance@harmonyed.com.


14) Entire Agreement; Assignment; Severability

These Terms, together with the Privacy Policy, are the entire agreement between you and Harmony regarding the Sites. You may not assign your rights or obligations without our consent. If any provision is found unenforceable, the remaining provisions remain in effect.


15) Portal Addenda (Incorporated)

The following additional terms apply where relevant and are incorporated by reference. If there is a conflict with the main Terms, these addenda control for their respective portals.

A) Vendor Portal Addendum

Vendors must keep account credentials confidential; use information solely to fulfill program services; comply with applicable student‑privacy laws and data‑security standards; and promptly notify Harmony of any incident affecting Harmony data. Vendors will enter into a separate data‑processing agreement where required.

B) Mentor/Employee Portal Addendum

Mentors and employees are bound by confidentiality and security policies; may access personal information only on a need‑to‑know basis; and must complete training and comply with role‑based access controls. Unauthorized access, export, or retention of student information is prohibited.

C) School Portal Addendum (FERPA)

When schools/districts use the portal, Harmony acts as a school official under FERPA with a legitimate educational interest, will use education records only to provide contracted services, will restrict access to authorized personnel, and will not re‑disclose except as permitted by law and agreement.
